Terms of Use

1.Who can use the Website

You must be at least 18 years old and able to enter into a binding contract under Indian law. If you use the Website on behalf of a company, you confirm you are authorised to accept these Terms for that company.

2.What these Terms cover and what they don't

These Terms cover use of the Website: browsing, candidate accounts, job applications, job alerts and enquiry forms.

Paid services for clients (recruitment, HR analytics, HR operations and HRIS, project support and induction events) are governed by a separate written proposal or agreement. That agreement covers fees, the replacement guarantee, confidentiality, data handling and non-solicitation. If it conflicts with these Terms, the client agreement wins.

Paid career services for candidates (such as coaching or interview prep) are governed by these Terms plus the price, scope and cancellation details shown when you book.

3.For candidates

3.1 Your account

• Give accurate, current and complete information, and keep it up to date.
• Create only one account, for yourself. Don't create accounts for other people.
• Keep your password and verification codes private. You're responsible for activity on your account. Tell us straight away if you think someone else has accessed it.

3.2 Your profile and resume

• Everything you submit must be true and your own. Don't claim qualifications, employers, job titles, salaries or certifications you don't have.
• We and the employers you apply to may verify your details. Background checks by employers happen only with your consent, under their own processes.
• Don't upload other people's personal data, confidential information from a current or past employer, or the sensitive items listed in section 4.4 of our Privacy Policy (such as Aadhaar or bank details).

3.3 Applications and employers

• When you apply for a role, you authorise us to share your profile and resume with that employer. We will not send your profile to other employers without asking you first.
• Job listings come from our clients. We take reasonable care to check that roles are genuine and that details are accurate, but employers set and may change the job details, salary and requirements.
• Hiring decisions are made by the employer, not by us. We don't guarantee interviews, offers, employment or any salary.
• Any job offer or employment contract is between you and the employer.

3.4 No fees for placement

We never charge candidates for job placement, interviews, shortlisting or offer letters. Placement fees are paid by employers. If anyone asks you for money in our name, it is fraud. Please report it to jessy.valles@classynexus.com and to cybercrime.gov.in (helpline 1930).

3.5 Paid career services

• Prices, what's included and session details are shown before you book.
• Cancellations: You may reschedule or cancel for a full refund up to 24 hours before a session. Later cancellations or no-shows are not refundable.
• Refunds are made to the original payment method within 7 working days.
• Career services improve your preparation. They don't guarantee a job, and buying them never affects whether we put you forward for roles.

4.For employers and enquirers

• Information you send through our forms must be accurate. Job details you give us for publication must be genuine, lawful and non-discriminatory. They must not ask for fees from candidates, and must not break employment, equal-opportunity or other applicable laws.
• You are responsible for the lawful handling of any candidate data we share with you. Use it only to assess candidates for the role concerned, protect it, and delete it when no longer needed, as data protection laws (including India's DPDP Act, 2023) require.
• Fees, introductions, guarantees and non-solicitation terms are set in your client agreement.

5.Acceptable use

When using the Website, you must not:

• Copy, scrape, harvest or bulk-download job listings, candidate data or content, by automated or manual means
• Contact candidates or clients you found through the Website for purposes other than those intended
• Impersonate any person or company, or misrepresent your connection with anyone
• Upload viruses or harmful code, or try to access accounts, admin areas or systems you're not authorised to use
• Probe, scan or test the Website's security without our written permission
• Send spam or unsolicited promotions, or use the Website for anything illegal, fraudulent, defamatory or harassing

We may remove content, and suspend or close accounts, that break these Terms.

6.Your content

You keep ownership of what you submit, such as your resume, profile and messages. You give us a non-exclusive, royalty-free licence to store, copy, format and share it only as needed to provide the services and as described in our Privacy Policy. This licence ends when your content is deleted, except for copies employers already received through applications you made.

7.Our content

The Website's design, text, logo, articles, templates, graphics and the name "Classy Nexus" belong to us or our licensors. You may view and share links to our pages, and download free resources for your own internal use. You may not republish, sell or pass them off as your own without our written permission.

Articles and resources are general information, not legal, tax or professional advice. Laws such as labour, payroll and statutory compliance rules change. Please take advice specific to your situation before acting.

8.Links and third-party services

The Website links to, or works with, third-party sites and services such as LinkedIn, Naukri, Indeed, WhatsApp and Google. We don't control them and aren't responsible for their content or practices. Their own terms and privacy policies apply.

9.Availability and changes

We work to keep the Website available and accurate, but we provide it "as is" and "as available". We may change, pause or discontinue features, remove job listings (for example, when a role is filled), or carry out maintenance, without notice.

10.Limitation of liability

To the fullest extent the law allows:

• We are not liable for indirect or consequential losses, lost earnings, lost opportunities or lost data arising from your use of the Website.
• We are not liable for employers' acts, omissions, hiring decisions or job offers, or for candidates' representations.
• Our total liability to you for any claim relating to the Website or career services is limited to the amount you paid us in the 12 months before the claim, or ₹5,000, whichever is higher.

Nothing in these Terms limits liability that cannot legally be limited, such as liability for fraud. Nothing affects any rights you have as a consumer under the Consumer Protection Act, 2019, or the consumer laws of the country where you live.

11.Indemnity

If you break these Terms, submit false information, or misuse candidate or employer data obtained through the Website, you agree to cover our reasonable losses and costs from third-party claims caused by that breach.

12.Suspending and closing accounts

You can delete your account at any time from your dashboard, or by emailing us. We may suspend or close an account that breaks these Terms, submits false information, or has been inactive for 24 months (after emailing you first, as the Privacy Policy explains). Sections 5, 6 (for copies already shared), 7, 10, 11 and 14 continue to apply after your account closes.

13.Privacy

How we collect, use, share and protect personal data is explained in our Privacy Policy, which forms part of these Terms.

14.Governing law and disputes

These Terms are governed by the laws of India. Please contact us first, since most concerns can be resolved quickly. If a dispute can't be resolved within 30 days, the courts at Thane, Maharashtra have exclusive jurisdiction, subject to any non-waivable right you have as a consumer to bring a claim where you live.

We acknowledge complaints within 2 working days and aim to resolve them within 15 days. For privacy complaints, see section 14 of the Privacy Policy.

16.General

• Changes: We may update these Terms. We'll post the new version with a new date and email account holders about significant changes. Continuing to use the Website after that means you accept the updated Terms.
• Severability: If any part of these Terms is found unenforceable, the rest still applies.
• No waiver: If we don't enforce a term straight away, we can still enforce it later.
• Assignment: You may not transfer your rights under these Terms. We may transfer ours as part of a restructuring or sale of the business, with notice to you.
• Entire agreement: These Terms, the Privacy Policy and, for clients, the client agreement, are the whole agreement about use of the Website.
